Information on client funding transfer timelines

When referring to transaction funding timelines, all funding timelines are determined following the client’s application approval and are subject to Fifo Capital’s credit and risk assessment. Failure of businesses to supply requested information may delay application approvals and therefore funding. Registering the outlined security may also impact the funding transfers. Funding may take in as little as four business hours and are subject to 3rd party bank transfer timings. Funding transfers maybe impacted by the client’s bank and Fifo cannot be held responsible for all such delays.

Fifo Capital takes no responsibility should the funding transfers timing change due to matters outside Fifo Capital’s control.

Notification of base rate

Fifo Capital’s current base rate, effective as of 22 March 2023, is 2.25%. This base rate may be used in determining your overall annual rate for one or more of our finance facilities. Where the base rate is used, it will be disclosed in your offer letter.

Limitation of our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our site; or use of or reliance on any content displayed on our site;
  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

You may link to our home page without our prior written consent if there is a clear relevant reason to link. Fifo Capital reserves the right to ask for any link to be removed, and you must comply with the removal of the link if Fifo Capital makes the request of you or a representative of your organisation.

Applicable law

We both agree these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by the laws of the State of Victoria and the Commonwealth of Australia.
